Information request and response under the Freedom of Information (Scotland) Act 2002


Information requested

I would like to request the following information in the form of a FOI request:

  • Please provide any notes from officials' meetings of the Orkney Ferry Replacement Taskforce, that have taken place since the previous meeting on June 13.
  • If any notes/records were taken from the August 17 meeting of the full taskforce — beyond the minutes — please provide those as well.

I enclose a copy of most of the information you requested.

An exemption applies under section 33 (1)(b) (Substantial prejudice to commercial interests) Information is exempt if its disclosure would, or would be likely to, prejudice substantially the commercial interests of any person. “Person” includes a public authority, company and partnership. A further exemption under section 38(1)(b) (personal information) of FOISA applies to some of the information you have requested. 

These exemptions are subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption.
