I am looking for some Scottish reports but I am unable to find them online. Please can you help?
Response
In your correspondence you have asked for a number of different Scottish Government reports. The majority of reports requested, with the exception of Report 2, Report 11 and Report 12, are already available online and the links of where to find these have been shared with you. For some of the reports requested, no date was specified and therefore in such instances this request has been interpreted as the most recent report available. I enclose our response below each request.
1. Response to Scottish Commission on Social Security’s Scrutiny Report on the Social Security (Up-rating) (Miscellaneous Amendment) (Scotland) Regulations 2022.

2. Report to the Scottish Parliament on Orders regulating the management of Shellfisheries under the Sea Fisheries (Shellfish) Act 1967.
As the information you have requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.
This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.
Our response to this specific request will therefore be provided under the Environmental Information (Scotland) Regulations 2004 (EIRs) due to the content of the report being of an environmental nature.
I attach a copy of the Sea Fisheries (Shellfish) Act 1967 report to the Scottish Parliament for the year ending 31 December 2020. This is the latest report we held on the date of this request (08 November 2023).
The annual report on Regulating and Several Orders for 2021-2023 was submitted to Parliament on 20 November 2023, after your request was received. However, under our regulation 9 duty to provide advice and assistance under the EIRs, we are also attaching a copy of the Sea Fisheries (Shellfish) Act 1967 report to the Scottish Parliament for the year ending 31 December 2023.
3. Statement of Reasons: The Social Security (Up-rating) (Miscellaneous Amendment) (Scotland) Regulations 2022.
The Scottish Government did not publish a statement of reasons in relation to the Social Security (Uprating) (Miscellaneous Amendment) (Scotland) Regulations 2022. However, under the terms of section 86A of the Social Security (Scotland) Act 2018, Scottish Ministers are obliged to report each financial year on their assessment of the effects of inflation on most social security rates. This report underpins the later regulations. It was published 09 December 2021 and can be found here: Social Security assistance - effects of inflation: report 2021-2022 - gov.scot (www.gov.scot). Please note that this report predates the change in up-rating policy for 2022-23 which is set out in correspondence with the Scottish Commission on Social Security.
4. Report to the Scottish Parliament in respect of changes to The National Health Service Pension Scheme (Scotland).
I attach the latest copy of the report we held on the date of this request 08 November 2023.
5. Response to Scottish Commission on Social Security’s Scrutiny Report on the Disability Assistance for Working Age People (Transitional Provisions and Miscellaneous Amendment) Regulations 2022.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section 17(1) of FOISA applies to that information. The reasons why that exemption applies are explained below.
