Communications regarding named UK citizens in Gaza: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.


Information requested

All electronic information in respect of communication between Humza Yousaf, or anyone on his behalf, and any other authority (Scot Gov, UK Gov, foreign gov etc) relating to Elizabeth El-Nakla and her husband Maged (his parents in law) and any other family member whilst they were in Gaza. The period this request relates to is between 7 October 2023 and 4 November 2023.

I enclose a copy of some of the information you requested.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemption under section 38(1)(b): Personal information relating to third party of FOISA apply to that information. This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

In addition, exemptions under sections 30(b)(i) Free and frank provision of advice, 32(1)(a)(i): Relations between UK and any other state and 32 (1)(a)(iv): Promotion or protection of UK interests abroad of FOISA applies to some of the information you have requested. These exemptions are subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption.
