Correspondence with Education Scotland (ES) regarding practical materials developed on behaviour in schools: FOI release

Information requested

Any correspondence between Education Scotland and Scottish Government ministers or Scottish Government officials in relation to practical materials it developed on areas such as expectations and consequences (with regards to behaviour in schools, as referenced by the Cabinet Secretary in her statement to parliament of 29 November 2023).

Response

Please see the attached Annex which provides you with correspondence between Education Scotland and Scottish Government officials in relation to practical materials it developed on areas such as expectations and consequences between August – November 2023.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information within the Annex because an exemption under section 38(1)(b), personal information of FOISA applies to that information because it is personal data of a third party, i.e. staff who work for Education Scotland and the Scottish Government, and disclosing their personal information would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018.

This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

The professional learning presentations and notes on the Hub page were added recently at the request of the Scottish Government in preparation for the November Behaviour Summit, however, these resources were always intended to sit on our Inclusion, Wellbeing and Equalities Professional Learning Framework under the Relationships tab. The Professional Learning Framework has been developed around and in response to four common themes - requiring system level action/support, emerging from the Additional Support for Learning (ASL) Implementation Review (Morgan), The Promise, and the UNCRC (Incorporation) Bill. The Framework was due to be published in late October 2023 but has been delayed due to capacity issues in our Web Content team.
