Information requested
There were 7,208 convictions for bail-related offences in 2021-22, an increase of 14% on 2020-21 (6,331). Can I have a breakdown of what the offender was on bail for at the time please? And what was the offence that broke their bail?
Response
The Scottish Government does not hold the information requested in your first question. Following our communication with the Scottish Courts and Tribunal Service (SCTS), it has been confirmed that they maintain the data you have asked for. However, to obtain this information it would require SCTS to query court records which are exempt from disclosure due to the exemptions within Section 37(1) of FOISA, therefore this request would be refused by SCTS.
This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have some of the information you have requested.
I enclose the information you requested in your second question below.
The bail-related offences with a conviction published in Table 14 of the Criminal Proceedings in Scotland 2021-22 bulletin records the number of offences under relevant sections of the Criminal Procedure (Scotland) Act 1995 that correspond to the two crimes of Bail offences other than absconding or reoffending and Failing to appear for trial having been given court bail. The number of offences under each crime and charge (relevant section of the act) are shown in the table below. Note that with respect to the former crime we do not hold any further details on the exact condition(s) of bail that were breached.
