Information requested

The following information on this government framework which runs for the period of 2020-2024.

Title: Recruitment Advertising and Public Information Notices

We'd like a FOI version of the winning tenders bid which was TMP UK. We'd also like to request the scoring of the winning tenderers bid.

We'd also like to find out how many bidders applied to be on this framework. The make up of these bidders (SME or No).

We'd also request if the intention of this framework was to award to a single bidder? or whether the intention was to award to multiple bidders.

Response

I enclose a copy of some of the information you requested, namely a copy of the winning tenderers bid and the scoring of the bid.

Exemptions under sections 33(1)(b) Substantial Prejudice to Commercial Interests and 38(1)(b) Third Party Personal Data of FOISA applies to some of the information you have requested.

Exemption 33(1)(b) Substantial Prejudice to Commercial Interests is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. We recognise that there is some public interest in release in order to have transparent tendering processes. On the other hand, if commercially sensitive information is made public, it is likely to damage the commercial interests of the company whose information is released. This, in turn, could mean that the Scottish Government may be unable to generate genuine and effective competitive tendering processes, and that, in our view, would not be in the public interest.

Exemption 38(1)(b) Third Party Personal Data is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

There were two bidders for this framework (including the successful tenderer). One bidder was an SME.

Our procurement strategy for delivery of this Framework was to award a single supplier framework.
