Records Management Policy 2007: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002

Information requested

Let me know in the interim what year the policy covering 2007 was published.

Point me in the direction of the policy that applied in 2007.

Response

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section s.38(1)(b) (personal information) of FOISA applies to some of the information requested because it is personal data of a third party, ie names of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

The attachment with this response has been redacted under this exemption.

The Public Records (Scotland) Act 2011 introduced the requirement for the Scottish Government to put in place a Records Management Plan of which the Records Management Policy is part.

The Records Management Manual which was published on the Scottish Executive website in 2005 and has been since been archived.

( [ARCHIVED CONTENT] SCOTTISH EXECUTIVE RECORDS MANAGEMENT MANUAL: 2005 Version (nrscotland.gov.uk) )

This was updated in 2006 due to the rollout of an Electronic Document and Records Management system and would have applied in 2007. A copy of this manual is attached to this response.
