Breaches of the Ministerial Code: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.


Information requested

1. The text of the 20 most recent complaints submitted against Scottish Government Ministers that were reviewed against the ministerial code.

2. The text of the 10 most recent complaints of minsters that were upheld i.e it was judged they had broken the ministerial code.

Response

In response to the first part of your request, I enclose a copy of the information you requested at Annex A.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under s.38(1)(b) (personal information) of FOISA applies to that information. You will note that I have redacted the names and contact details of some of the authors and recipients of the correspondence provided in response to this request so as not to breach the General Data Protection Regulation.

This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

In response to the second part of your request, this is a formal notice under s17(1) that the Scottish Government does not hold the information you have requested. We do not hold any information to suggest that any complaints made against Scottish Ministers citing the Scottish Ministerial Code have been upheld.
