Figures for professional conduct complaints raised in year 2023: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.

Information requested

“Can you please supply your figures for professional conduct complaints raised in year 2023 and what the outcomes of these were.”

Response

We have interpreted your request to mean conduct cases dealt with under our internal disciplinary or grievance policies in the year 2023. If that interpretation is incorrect please let us know.

Civil Servants employed by the Scottish Government must comply with the conduct standards set out in the Civil Service Code (see - The Civil Service code - GOV.UK (www.gov.uk)). Where these standards are not met, we have robust procedures in place to deal with misconduct and/or grievances.

Between the period 1 January 2023 to 31 December 2023, there were 10 grievance cases and 7 disciplinary cases.

Of the 10 grievances, 3 cases were investigated and training was recommended. 1 case was investigated but no follow up action was considered appropriate. The other 6 are still open and outcomes to be determined.

Of the 7 disciplinaries, 2 cases were concluded with no further action required and 2 cases were concluded following investigation and resulted in a disciplinary penalty. Disciplinary penalties can include written warnings, training, downgrading and termination of employment. The other 3 cases are still open and the outcome yet to be determined.

Please note that the above data relates to cases within the core Directorates of the Scottish Government (see Annex attached).
