Correspondence regarding Chair of Ferguson Marine: FOI release

Information requested

1. A copy of any meeting minutes, external correspondence, read out of phone calls or any other documentation which relate to the Cabinet Secretary’s discussions with the Board of Ferguson Marine about Mr Tydeman’s performance and position as Chief Executive on 28th February. Please also include any internal correspondence about the setting up of any meeting, briefing notes or other documents and noted outcomes from any meeting.

2. A copy of any meeting minutes, external correspondence, read out of phone calls or any other documentation which relate to the Cabinet Secretary’s being informed by the Board of Ferguson Marine about Mr Tydeman’s position as Chief Executive on 18th March. Please also include any internal correspondence including emails or WhatsApp messages about this decision, such as media planning or the signing of any media lines.

I enclose a copy of some of the information you requested.

While our aim is to provide information whenever possible, in this instance the Scottish Government does not have some of the information you have requested. We do not hold any meeting minutes, or read out of phone calls from the 28 February relating to the Cabinet Secretary's discussions with the Board of Ferguson Marine about Mr Tydeman’s performance and position as Chief Executive. Similarly, we do not hold meeting minutes, or read out of phone calls or any Whatsapp messages, media planning or media lines from the 18th March relating to the Cabinet Secretary being informed by the Board of Ferguson Marine about Mr Tydeman’s position as Chief Executive.

This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have some of the information you have requested.

However, we do hold some of the information requested. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under Section 30(b)(i) – Free and Frank Provision of Advice, Section 30(b)(ii) – Free and Frank Exchange of Views, Section 33(1)(b) – Prejudice to Commercial Interests, Section 38(1)(b) – Third Party Personal Information of FOISA applies to that information. The reasons why the exemptions apply are explained in the Annex to this letter.
