Information requested

1. Could you supply all correspondence sent and received by the Scottish Government and/or Angus Robertson, including internally, briefings, minutes/notes from meetings which mentions or is from Edinburgh Film House, between August 2023 and the date of this FOI?

2. Could you supply all correspondence sent and received by the Scottish Government and/or Angus Robertson, including internally, briefings, minutes/notes from meetings, about the Tartan Week UK Government reception in New York, from between January 1 2024 and the date of this FOI? 3. Was Angus Robertson invited to the Tartan Week UK Government reception in New York, and if so, why did he not attend?

Response

In relation to your first question, while our aim is to provide information whenever possible, in this instance the costs of locating, retrieving and providing the information requested would exceed the upper cost limit of £600. This is because the request covers a large quantity of correspondence over a relatively long time frame. Under section 12 of FOISA public authorities are not required to comply with a request for information if the authority estimates that the cost of complying would exceed the upper cost limit, which is currently set at £600 by Regulations made under section 12

You may, however, wish to consider reducing the scope of your request in order that the costs can be brought below £600. This may be achieved for example by further specifying the information you are looking for, instead of all information that mentions ‘filmhouse’, or narrowing the time frame of your request. In relation to your second question, while our aim is to provide information whenever possible, in this instance we are unable to provide some the information you have requested because an exemption under section s.38(1)(b) (personal information) of FOISA applies to that information. The reason why that exemption applies are explained below.

An exemption under section s.38(1) of FOISA applies to some of the information you have requested. This is because the information contains email correspondence with personal data. This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

The answer to your third question is that the Cabinet Secretary was invited to the UK Government’s reception on Wednesday 3 April but was unable to attend as it conflicted with a Food and Drink Showcase organised by Scottish Development International, where he delivered welcome remarks.
