Response

Further to my letter of 24th April 2024, I have now completed my review of our response to your request under the Freedom of Information (Scotland) Act 2002 (FOISA).

1. The dates of all meetings held, in person, telephone or virtual between Maree Todd MSP, then Minister for Children and Young People, and the Chief Executive and Chair of Children's Hearings Scotland from 07 November 2017 to 01 July 2021.

2. All correspondence (including emails, letters, telephone calls and text messages) between Maree Todd MSP, then Minister for Children and Young People, and the Chief Executive and Chair of Children's Hearings Scotland from 07 November 2017 to 01 July 2021.

I have concluded that the original decision should be confirmed, with modifications.

Upon carrying out this review it has come to my attention that the attached documents, which fall within scope, were not included in our original response. I have now considered this information for disclosure and copies are attached.

I apologise for these documents not being included in our original response, I have shared the review conclusions with the team responsible for providing our initial response to ensure that relevant information is identified and considered at request stage going forward.

While we aim to provide information wherever possible, in this case the exemption at section 38(1)(b) of FOISA (personal information) applies to a small amount of the information requested because it is personal data of a third party, ie names/contact details of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
