Information request and response under the Environmental Information (Scotland) Regulations 2004.
Information requested
For the M90 between Junction 10 and 11.
A copy of your current road and pavement maintenance policy relating to that road. Please send me the full policy, but this should include details of the intended frequency of road safety inspections, how these inspections should be conducted and the maximum time between identification of a defect and repairs being carried out.
A copy of the road/pavement repair history for that road over the past year. Again, please send me the full road repair history, but this should include:
- Dates of all safety inspections between in 2023 and 2024.
- Details of how safety inspections were undertaken (walked or driven, speed of inspection vehicle etc).
- Details of all carriageway defects identified, with description, date and time.
- Details of how the authority handled these defects, what repairs were undertaken and the time between the identification of each defect and a repair being carried out.
Detail of any reports made by the public or claims initiated in relation to defects found in this section of highway.
Any photographs relating to or taking during the roadworks taking place in March 2024, such as diary of works etc – 01/03/24 – 31/03/24.
You clarified on 3 June that the question related to roadworks is details on the road works that were set up between these two junctions in March 2024 (Namely 24th March). There was a contraflow system in place.

2. Dates of all safety inspections – 29/05/23 – 29/05/24
An exception under regulation 11(2) of the EIRs (personal information) applies to some of the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.

Safety Inspections are driven, inspections not exceeding 50mph.
4. Details of all carriageway defects identified, with description, date and time – 29/05/23 – 29/05/24

Please see Annex C and D to this response, photographs and work records relating to the contraflow closure which was installed on the M90 Friarton Bridge to carry out series of work activities, the photos are of the navigation light inspection and a carriageway repair.
