Information requested
How many staff worked overtime or logged out of hours working, broken down by role, grade, from 25 April until the day following the resignation speech?

I enclose a copy of most of the information you requested.
The attached spreadsheet shows that, between 25th April until 30th April, 142 staff at Bands A-C grades worked overtime at their manager’s request in Scottish Government Core. Please note that overtime worked between 25-30th April was not necessarily linked to First Minister’s resignation.
Senior Civil Servants are not eligible for overtime as per the terms and conditions of their employment, and so are not included in the overtime data provided.
While we do ask most staff to record their hours through the Flexi Time system, Scottish Government does not have ‘core working hours’. The Scottish Government’s flexible working policy sets out that hours should be worked between the bandwidths of 07:00 to 19:00, Monday to Friday. The attached spreadsheet shows that, from 25th April to the 30th April inclusive, 911 staff clocked in before 07:00, clocked out after 19:00, or at the weekend. Staff and line managers will agree how hours worked outwith flexi bandwidths are reimbursed, e.g. a flexible working hours credit, or where appropriate, a payment of overtime/ travel time. Please note that staff clock-ins/ clock-outs outside the standard flexi bandwidth are not necessarily linked to First Minister’s resignation.
While the Scottish Government’s aim is to provide information wherever possible, an exemption under s.38(1)(b) applies to your request. This exemption applies to some of the information requested because it is personal data of a third party / parties and disclosing it could lead to their identification and would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
We are therefore unable to provide information by role title as requested.
