Information request and response under the Freedom of Information (Scotland) Act 2002.
Information requested
A - The current organizational chart showing the identities of managers and senior executives, their job titles (and if it is not obvious, the scope of their roles) showing lines of responsibility.
B - The Respondent will be aware that it holds multiple legal identities in addition to its own, and in every sequestration trusteeship it acquires an additional legal personage as trustee.
In those cases, the Respondent’s staff are necessarily involved in executing such trusteeship duties (as are not contractually delegated to a private sector company).
Upon the assumption that the requested chart does not do so, please identify those individuals whose responsibilities involve acting both as trustee and for the AIB in some other capacity, particularly identifying involvement in regulatory, audit, recall and other processes that are specifically referenced in the relevant bankruptcy legislation.
C – Please confirm whether all such staff are employed by the AIB – the same legal person.

An exemption under section 38,1,(b) of FOISA applies to some of the information you have requested. This information is exempt as it constitutes personal data and cannot be disclosed. Disclosure would contravene the data protection principles as defined in the Data Protection Act 2018.
This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
C - All staff are employed by the Accountant in Bankruptcy.
Accountant in Bankruptcy(AiB) is an Executive Agency. As such it operates impartially while remaining directly accountable to the Scottish Ministers for its performance and use of public funds.
The Chief Executive is also The Accountant in Bankruptcy, an independent statutory officer of the court appointed under section 199 of the Bankruptcy(Scotland) Act 2016, as amended. The Accountant in Bankruptcy is also the Debt Arrangement Scheme(DAS) Administrator appointed
by virtue of section 8 of the Debt Arrangement and Attachment(Scotland) Act 2002.
