Response
This is a formal notice under section 17(1) of FOISA that the Scottish Government does not hold the information you have requested. However, the Mental Welfare Commission which is an independent organisation, reports to Scottish Ministers and has a statutory duty to monitor the use of the Mental Health (Care and Treatment) (Scotland) Act 2003. They do this by collating and analysing data compiled from the relevant paperwork provided to them by Health Boards and by publishing statistical reports. The MWC do publish data concerning detention rates and this can be accessed using the following link: Search | Mental Welfare Commission for Scotland (mwcscot.org.uk).
