Paper on Joint Programme Monitoring Committee (JPMC): FOI Review

The minutes of the May 2016 meeting of the Joint Programme Monitoring Committee (JPMC) are available here:

They include the following remark:

“A paper was presented to the Committee on risks and issues with the 2014-2020 programmes.”

Please provide the above mentioned paper.

Response

Further to my letter of 19 July 2024, I have now completed my review of the response to your request under the Freedom of Information (Scotland) Act 2002 (FOISA) for the following information:

“The minutes of the May 2016 meeting of the Joint Programme Monitoring Committee (JPMC) are available here: https://www.gov.scot/publications/jpmc-minutes-may-2016/ 

They include the following remark:

“A paper was presented to the Committee on risks and issues with the 2014-2020 programmes.” Please provide the above mentioned paper.”

I have concluded that a different decision should be substituted.

I understand that you have now received a copy of the paper requested under separate cover, sent on 18 July. I apologise for the mishandling of your original request. Your request was clear and we
provided you with no reason in terms of FOISA as to why the requested information could not be provided, nor did we provide you with information on your right to request a review. As a result the
response provided did not comply with our obligations under FOISA, which we take seriously. I have discussed with the original case handler and with others across the team to ensure we closely adhere to FOISA guidelines and apply consistency when responding to requests under FOISA to prevent further recurrence of this error.

While I note that you have now been provided with the paper in question, I have concluded that that this should have been provided to you on receipt of your original request and am providing a copy again here.
