Latheronwheel correspondence: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.


Information requested

All correspondence from Roy Brannen concerning Latheronwheel. Would it be possible to have this provided please?

In addition, constituents have raised concerns about the lack of a dropped kerb at the bus stop in Latheronwheel, which is making the bus stop inaccessible and unsafe for some residents of the village. Could the installation of a dropped kerb be considered?

Response

An exemption under section 38(1)(b) of FOISA (personal information) applies to some of the information requested because it is personal data of a third party, ie name and contact details of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

Unfortunately, our Operating Company’s active travel and routine maintenance budgets are fully committed for this financial year 2024/2025, however, subject to approval and available funding, this location will be added to the list of sites for attention next year (April 2025 onwards). Should capacity become available later this year, it may be possible to progress works sooner.
