Licences for stocking hatchery-reared brown trout in the Diebidale River: EIR Release

Information request and response under the Environmental Information (Scotland) Regulations 2004.


Information requested

A copy of any current licence in place for the stocking of hatchery-reared brown trout in the Diebidale River (or any part thereof), a major tributary of the River Carron (Sutherland). If no such licence exists (rendering any stocking illegal), you asked for advice on what enforcement action will be taken to remedy the situation.

Response

1. I enclose a copy of most of the information you requested. Your request for advice on enforcement action is not within the scope of this response as a licence is in place.

2. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exception(s) under regulation 11(2) of the EIRs (personal information) applies to that information. The reasons why that exception(s) applies are explained in the Annex to this letter.

Additional information provided out with the EIRs

Under regulation 9 of the EIRs (our duty to provide advice and assistance) we would like to provide advice on your associated query regarding enforcement action. As the licensing authority, Marine Directorate does not have any powers of investigation or enforcement as regards illegal stocking.

General arrangements for enforcement are that if an individual or Marine Directorate has concerns that unauthorised stocking has, or is happening, they can report it to the Police Scotland Wildlife Crime team on 101, anonymously on 0800 555 111 or by email at contactus@scotland.pnn.police.uk.
