Can you confirm if the pathway on the A77 between the Holmston Roundabout and Whitletts is subject to the same schedule?

I would like evidence of this for comparison purposes before I pursue the matter with the H & Safety Executive.

Response

These questions were an addition to your request for a review of the previous reply under reference 202400422702. The review will be answered under reference 202400426359. As the information you have requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

The footway between Holmston and Whitletts Roundabout is subject to the same inspection schedule as other footpaths. The agreed maintenance schedule for this section of the A77 is for an inspection to be carried out once a year with the next inspection due in November.

Annexes A and B showing an extract from Transport Scotland’s Trunk Road Information Manual and screenshots respectively, which show footways in both stretches of the A77 have the same category, and are maintained under the same regime.
