Information request and response under the Freedom of Information (Scotland) Act 2002.
Information requested
All correspondence between the Scottish Government and Keir Starmer, including minutes/notes from meetings and briefings notes, plus emails, from the last three months.
Response
Our aim is to provide information wherever possible and I enclose copies of some of the information you requested. However, exemptions under sections 28(i), 30 (b)(i), 30(b)(ii) and 38(i)(b) of FOISA apply to some of the information you have requested.
Some of these exemptions are subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the relevant exemptions.
Exemptions under section 38(1)(b) of FOISA apply to some of the information you have requested. This concerns personal data of third parties and is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
