Annex A – Reasons for Not Providing Information
The Scottish Government does not hold the information requested
The Scottish Government does not have the information you have asked for in relation to the ‘Scottish Mental Health Law Review Consultation’ and the ‘Scottish Mental Health Law Review - Additional Proposals’ consultation.
The Scottish Mental Health Law Review (SMHLR) was an independent review and was not subject to FOI. The total number of published responses to the SMHLR consultation and the Additional Proposals are available within the links you provided.
Responses can only be viewed where consent has been given to publish the response and the answers provided can be clearly identified as an individual or an organisation response.
As the SMHLR was an independent review, the Scottish Government does not have access to the responses where no consent was provided to publish the response.
As such, I hereby provide you with formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.
