Correspondence and queries relating to HMP Glasgow: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.


Information requested

1) Any and all correspondence relating to the design of the new HMP Glasgow.

2) Actions logged on internal Scottish Government systems in relation to HMP Glasgow.

3) The Scottish Government's risk register for HMP Glasgow.
For clarity, correspondence includes, but is not limited to, emails, meeting minutes, WhatsApp or other informal messages and phone logs.

Response

I enclose a copy of some of the information you requested. The reasoning for not providing all information requested is detailed below.

Ask 1:

While our aim is to provide information whenever possible, in this instance the costs of locating, retrieving and providing the information requested would exceed the upper cost limit of £600 due to the volume of correspondence which falls within scope of your ask. Under section 12 of FOISA public authorities are not required to comply with a request for information if the authority estimates that the cost of complying would exceed the upper cost limit, which is currently set at £600 by Regulations made under section 12.

You may, however, wish to consider reducing the scope of your request in order that the costs can be brought below £600. This may be achieved by providing a specific timeframe or a more specific request regarding the information you are looking for. You may also find it helpful to look at the Scottish Information Commissioner's 'Tips for requesting information under FOI and the EIRs' on his website at: http://www.itspublicknowledge.info/YourRights/Tipsforrequesters.aspx.

Ask 2:

The action log that has been found to be relevant to your request can be found in Annex A of this response.

Please be advised some information has been redacted due to the exemption under section 30 of FOISA, “30(b) Free and Frank Provision of Advice or Exchange of Views” which applies to that information.

Ask 3:

The HMP Glasgow project is being delivered by the Scottish Prison Service, and they are responsible for holding and maintaining associated risk registers. The Scottish Government does not own the risk register for this project, and we are therefore unable to provide this information.
