While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption(s) under section 33(1)(b) ‘Commercial interests’ of FOISA applies to that information.
An exemption(s) under section 33(1)(b) of FOISA applies to recipients of the Smart Pay Grant Fund and payments made under BSOG/NSG/CSG/CSG-R that are under £25k of the information you have requested.
This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. We recognise that there is some public interest in release because it provides detail on how taxpayer money is invested. However, this is outweighed by the public interest in revealing information for smaller bus operators which would provide competitors with a level of detail of their operations and an insight into their business that would jeopardise their competitive tendering for current and future routes that were offered by local authorities or transport partnerships. The totals BSOG/NSG/CSG/CSG-R for the last five years are provided in the attached spreadsheet.
