A83 Rest and be Thankful road closures: EIR release

Information request and response under the Environmental Information (Scotland) Regulations 2004.


Information requested

"I'm getting in touch regarding closures at the A82 Rest and be Thankful in Argyll and Bute. I'd like to know how many days over the past 10 years the route has been shut to traffic? If you could please offer a breakdown of closures per month between January 2015 and October this year it would be much appreciated."

Response

As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

For the purposes of this request we have assumed that the A82 was a typo and you are actually referring to the A83.

Please see Annex A to this response for details of closures from 1 January 2015 until 18 October 2024 (the date of your request). Please note, the closure information has been split into the following 3 categories:

  • The number of days the A83 trunk road was closed at the Rest and Be Thankful and the Old Military Road Diversion Route was in place.
  • The number of days the A83 trunk road was closed at the Rest and Be Thankful and the Standard Incident Diversion Route (A83/A82/A85/A819/A83) was in place
  • Network Related Closures not related to landslides or hillside issues.
