We have interpreted your request to be letters and emails exchanged between Scottish Government Minsters and Mark Ruskell between the 8th May and the date of your request.

I enclose a copy of most of the information you requested. This is attached in Annex A.

An exemption(s) under section(s) 29(1)a, and section 38 (1)b of FOISA applies to some of the information you have requested. Further information about these exemptions is included at the bottom of this letter in Annex 1.

Annex 1

An exemption under s.29(1)(a) – The formulation or development of governmental policy – of FOISA applies to some of the information you have requested. Information is exempt under s.29(1)(a) if it relates to the formulation or development of government policy. This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. We recognise that there is some public interest in release, however, this is outweighed by the public interest in ensuring that government policy and be formulated or developed in a protected environment.

An exemption under s.38(1)(b) – 3rd party personal information – of FOISA applies to some of the information you have requested. Information is exempt under s.38(1)(b) if it is the personal information of a 3rd party. For the purposes of this application this exemption is absolute and not subject to the 'public interest test'.
