Information request and response under the Freedom of Information (Scotland) Act 2002.
Information requested
1. The last piece of correspondence the Scottish Government has had with each health board regarding the delivery of annual health checks for people with learning disabilities. Please include the full correspondence. Including replies from either relevant Scottish Government department or the health board.
2. A copy of the latest briefing material on Annual Health Checks for People with learning disabilities. Please include anything that was prepared either for the Minister of Social Care Maree Todd, Cabinet Secretary for Health Neil Gray, and the First Minister John Swinney. Presumably one will have been made lately as the Scottish Government responded to a media request.
3. Please provide a copy of any Scottish Government analysis that has been done as a result of health boards reporting the numbers to the Scottish Government.
4. If Minister Maree Todd and Cabinet Secretary Neil Gray have whatsapp or text messages, then please provide a copy of any messages in the last two days (19th to 20th Nov) that relate to the mention of annual health checks for people with learning disabilities.
5. Copies of any emails that have been sent or received by Minister Maree Todd or Neil Gray (or anyone in either of their offices) in the last four days (18th to 21st November time period covered ) that relate to annual health checks for people with learning disabilities.
Response
I enclose a copy of most of the information you requested in the format you asked for. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section s.38(1)(b) of FOISA applies to that information. The reasons why that exemption applies are explained in the Annex to this letter.
The answer to your questions are;
1. Our last piece of correspondence we have had with each of the Boards regarding the delivery of annual health checks for people with learning disabilities was the minutes of the November meeting of the National Implementation Group for annual health checks and I attach a copy of the minutes with this response.
2. Our latest briefing material was in the form of an FMQ briefing and I have attached a copy of that FMQ briefing with this response.
3. I have attached a copy of a table detailing the numbers analysed from each Board during the annual required reporting period as of 31st March 2024.
4. There were no whats app or text messages between Minister Maree Todd and Cabinet Secretary Neil Gray within the time frame requested relating to annual health checks.
5. There was one email sent or received by Minister Maree Todd or Neil Gray (or anyone in either of their offices) within the time frame requested relating to annual health checks. The email concerns a media query about annual health checks and I have attached a copy of the email trail with the response.
Annex - Reasons for not providing information (As referenced above)
An exemption applies
An exemption under section s.38(1)(b) (personal information) of FOISA applies to some of the information you have requested. It would include names, email addresses and personal information and is therefore not included in the response.
