Protecting Vulnerable Groups (PVG) list removals: FOI release

Information requested

How many people, after a period of time has elapsed from being placed on the PVG list, have been successful in having their names removed from

  • The children's list
  • The adult's list
  • The list that includes both children and vulnerable adults.

Is there a breakdown of the timescales for these removals (i.e. After five years, after 10 years, etc.)?

Response

I have structured the answers to your questions in a way that I hope is useful.

There are 29 individuals who have been removed from the barred lists. These consist of:

  • 13 individuals removed from the children’s list
  • 4 individuals removed from the adult’s list
  • 12 individuals removed from both lists

In total, 16 individuals were removed from the adult’s list, and 25 from the children’s list.

Regarding timescales of removals, according to Section 25 of the Protection of Vulnerable Groups (Scotland) Act 2007, individuals may only apply for removal after a prescribed period of 5 or 10 years, or ministers are satisfied that there has been a relevant change to the applicant’s circumstances since listing. These three categories are broken down as follows:

Applied for removal after a prescribed period of 5 years:

  • 5 individuals were removed from the children’s list
  • 4 individuals were removed from the adults list

Applied for removal after a prescribed period of 10 years:

  • 6 individuals were removed from the children’s list
  • 4 individuals were removed from the adults list

Applied for removal before a prescribed period of time

  • 14 individuals were removed from the children’s list
  • 8 individuals removed from the adult’s list
