A copy of the due diligence assessment conducted during the Scottish Governments renewal of the desktop contract with HP in 2023.

Response

The answer to your question is the Scottish Government undertake all procurements in accordance with the Public Contracts (Scotland) Regulations 2015.

The Single Procurement Document (SPD) is a standard questionnaire that allows buyers to conduct due diligence in the selection of potential suppliers. The SPD allows buyers to ask questions to identify suitably qualified and experienced bidders and ensure that potential suppliers are lawful, capable and financially stable.

The SPD includes questions relating to activities which could exclude suppliers from the public sector procurement process. The potential grounds for exclusion include having been convicted of certain criminal offences including those relating to conspiracy, corruption, fraud or bribery. Companies may also be excluded where they are in breach of their obligations to pay taxes or social security contributions or have been convicted of offences related to Human Trafficking, Drug Trafficking, money laundering or in connection with the Counter Terrorism Act.

The SPD may also be also be used to gather information relating to financial capacity, and technical and professional ability. In addition to completing the SPD, HP Inc UK Ltd were also required to complete a Supplier Assurance Questionnaire - Cyber Security.

Following completion of the SPD there were no grounds for the exclusion of HP Inc UK Ltd from participating in the procurement for the renewal of the Desktop Client Device contract in 2023.
