Freedom Of Information Act Part 6 of The Transport Scotland Act 2019: FOI Release

Information request and response under the Freedom of Information (Scotland) Act 2002.

Information requested

I respectfully recorded or not in the terms of the Freedom Of Information Act Part 6 of The Transport (Scotland) Act 2019 in terms on pavement parking, double parking and parking at dropped kerbs to make it easier for local authorities to ensure our pavements and roads are safer and more accessible to all and the date when such has been devolved or to be devolved to Local Authorities in Scotland so that core elements Part 6 of The Transport (Scotland) Act 2019 can be implemented by the Local Authorities in Scotland..

Response

Transport Scotland are currently running a public consultation on the Enforcement Regulations which will be required to allow local authorities to issue Penalty Charge Notices (PCNs) for the new parking prohibitions for pavement, dropped kerb & double parking.

These new regulations are due to be reviewed by the Scottish Parliament later in the year and if confirmed are currently due to come into force during December this year.
