Information from ANPR cameras on the M8 being given to Police Scotland: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.


Information requested

  1. How many times has information obtained by ANPR cameras situated on the M8 motorway from 2011 to 2022 been given to Police Scotland.
  2. All correspondence and information including but not limited to documents, reports, calls logged, notes of meetings and emails relating to ANPR cameras between Transport Scotland and Police Scotland.

Response

  1. Transport Scotland has not issued information obtained from ANPR cameras on the M8 to Police Scotland between the dates in question.
  2. Please see Annex A to this response for copies of all correspondence we hold relating specifically to ANPR cameras on the M8 trunk road between 2011 until 2022.

An exception under regulation 11(2) of the EIRs (personal information) applies to some of the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exception is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.
