Interventions on where to site a prisoner with Scottish Prison Service: FOI release

Information requested

  1. How many times has the Scottish Government intervened to tell the Scottish Prison Service where to site a prisoner? Breakdown by year, and what prison they were told to send them to, the one they were originally meant to go to and reasons for this?
  2. Timeline of events following the Isla Bryson court case involving the Scottish Government?
  3. Did officials from the government know about the court case and when did they find out
  4. What was the protocols for the Scottish Government when it came to the Scottish Prison Service selecting what jail a trans person is put to before the pause announced last Sunday?

Response

I enclose a copy of some of the information you requested. For part 1 of your request, this is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested. The management of individual offenders, including their location, is an operational matter for the Scottish Prison Service and the Scottish Government does not hold information relating to where prisoners are sited. The Scottish Government has not intervened on any decision made by SPS.

In addition, some of the information you have requested is already published. Information on the published information relevant to your request is detailed in the Annex. Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you. If, however, you do not have internet access to obtain this information from the website(s) listed, then please contact me again and I will send you a paper copy.
