Details of the equality impact assessment (EQIA) carried out in relation to the Judicial Factors (Scotland) Bill.
Stage 3: Assessing the impacts and identifying opportunities to promote equality
Having considered the data and evidence you have gathered, this section requires you to consider the potential impacts – negative and positive – that your policy might have on each of the protected characteristics. It is important to remember the duty is also a positive one – that we must explore whether the policy offers the opportunity to promote equality and/or foster good relations.

Currently, a judicial factor may be appointed to manage the estate of a young person and the new regime will apply to any such appointments. Under section 9(5)(a) of the Children (Scotland) Act 1995, for example, the Accountant may apply to the court for the appointment of a judicial factor to administer property owned by or due to a child. In 2022, there was one active judicial factory under the Children (Scotland) Act 1995. The court appointment of a judicial factor who is subject to the ongoing supervision of the Accountant provides a high degree of protection for persons who are vulnerable because of their age. | ||
