Information requested

Please provide all correspondence between the Scottish Government and the Lord Advocate from June 2022 in relation to requests for the Lord Advocate to provide a statement to Parliament on her referral to the Supreme Court on the matter of an independence Bill being within the competence of the Scottish Parliament.

Response

While our aim is to provide information whenever possible, in this instance, exemptions under 29(1)(b) (Ministerial communications), section 38(1)(b) (personal data of a third party), section 30(c) (substantial prejudice to the effective conduct of public affairs), section 30(b)(i) (free and frank provision of advice) and 36(1) of FOISA (confidentiality in legal proceedings) apply to some of the information requested. The reasons why these exemptions apply is explained in Annex A of this letter.
