Information requested

All the minutes and reports of the Malnutrition Short Life Working Group (SLWG) to ascertain what is the current situation of malnutrition in Scotland and why it was not being monitored at all by the Scottish Government before now.

Response

  1. I enclose a copy of some of the information you requested.
  2. The answer to your question is the work of the SLWG to develop a framework for the prevention of malnutrition and dehydration is ongoing. The SLWG met for the first time on 22 November and I enclose a copy of the minutes of the meeting. This is the only meeting that was held before 31 December. While the COVID-19 pandemic and associated pressures impacted on progress, we remain committed to this work.
  3. While our aim is to provide information whenever possible, in this instance the Scottish Government does not have some of the information you have requested. The reasons why we do not have the information are explained in the Annex to this letter.
  4. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption(s) under section(s) s.38(1)(b) (personal information) of FOISA applies to that information. The reasons why that exemption(s) applies are explained in the Annex to this letter.

The Scottish Government does not hold the information requested

The Scottish Government does not have the information you have asked for
because the group has not yet prepared any reports.
As such, I hereby provide you with formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.

An exemption applies

An exemption under section s.38(1)(b) (personal information) of FOISA applies to some of the information you have requested because it is personal data of a third party, i.e. names/job title details of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
