You asked for all information or communication Ms Gilruth had with SG/TS relating to her time as Transport Secretary between 6th May 2023 and 17th May 2023.

I enclose a copy of the information you requested, in annex 1.

An exemption(s) under section(s) 30(b)(ii) - free and frank exchange of views; 38(b)(ii) - third party personal data of FOISA applies to some of the information you have requested.

An exemption under section 30(b)(ii) of FOISA (Substantial inhibition to free and frank exchange of views) applies to some of the information requested. This exemption applies because disclosure would, or would be likely to, inhibit the exchange of free and frank views. This exemption recognises the need for private space within which to discuss potential thoughts and suggestions when working with teams. This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information is outweighed by the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. Disclosing the content of free and frank exchanges could impact any potential advice or suggestions in future discussions. There is a greater public interest in allowing a private space within which such considerations and views can be exchanged.
