Notes taken at the meetings regarding Chris Gibb departure: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.


Information requested

  1. The minutes and/or notes taken at the meeting between Jenny Gilruth and Chris Gibb on December 8 2022.
  2. The minutes and/or notes taken at the meeting between Jenny Gilruth and Chris Gibb on December 20 2022.
  3. Any communications and/or record of communication between Bill Reeve and/or other sponsor team officials present at the Scottish Rail Holdings board meeting on December 8 2022, and Michael Matheson (or his advisers) and/or Jenny Gilruth (or her advisers) on this date or the seven days before and after this meeting.
  4. Any and all correspondence between Jenny Gilruth and Michael Matheson regarding Chris Gibb since April 2022 www.transport.

Response

For points 1,2 and 4:

We aim to provide the information whenever possible, however on this occasion the Scottish Government does not hold any information that falls into the scope of your request.

As such, for these parts of your request, I hereby provide you with formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.

For point 3:

Please see attached Appendix A which contains the information we hold, which falls within the scope of your request.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemption under section 38(1)(b) (personal information) of FOISA applies to that information. The reasons why this exemption applies are explained below:-

Section 38(1)(b) – Personal data of a third party

An exemption under section 38(1)(b) of FOISA (personal information) applies some of the information requested because it is personal data of a third party, i.e. names and contact details of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
