THE TOWN AND COUNTRY PLANNING (LIMIT OF ANNUAL VALUE) (SCOTLAND) ORDER 2010

Introduction

This circular explains the provisions of the Town and Country Planning (Limit of Annual Value (Scotland) Order 2010. The Order was made on 10 February 2010 and comes into force on 1 April 2010 (SSI 2010/49).

Background

3. The 2010 Order prescribes £30,000 as the annual value of hereditament for the purpose of sections 100 - 122 of the Town and Country Planning (Scotland) Act 1997. Under those sections, owner-occupiers can, in certain circumstances, require the appropriate authority to purchase their interest in the property provided that, in the case of a non-resident owner-occupier, the annual value of the non-domestic property does not exceed the prescribed amount.

4. The Town and Country Planning (Limit of Annual Value) (Scotland) Order 2005 which prescribed a limit of £28,000 is revoked. This circular supersedes Circular 2/2005 which accompanied the 2005 Order.
