Appeal form and guidance notes for a planning enforcement notice appeal.
A planning authority may take enforcement action if it thinks that development has been carried out without the required planning permission or where a person has failed to comply with a condition attached to a permission.
You have the right to make a planning enforcement appeal to Scottish Ministers where:
- a planning authority serves an enforcement notice on you and your land specifically
- you have an interest in the land covered by the notice
The attached guidance explains:

- how to complete and submit your form
- how to get in touch
- how to submit documents to the DPEA electronically
Your appeal must be made before the date that the notice is due to come into effect. This date will be clearly stated on the notice itself.
There is no fee for this type of appeal. Everybody who participates in the process is normally expected to cover their own expenses.
This appeal can also be made using the eplanning portal.
