Summary of aims and desired outcomes of policy

The aim of the Protected Trust Deeds (Miscellaneous Amendment) (Scotland) Regulations 2024 (the "Regulations") is to make improvements to the operation and delivery of Protected Trust Deeds (PTDs).

The proposals contained in the Regulations will help ensure this statutory debt solution is fit for purpose. This includes making the good practice introduced through a voluntary protocol a statutory requirement.

These Regulations also aim to offer further protections to those who are seeking debt relief through PTDs, including making a provision that a person can be discharged from the PTD in extenuating circumstances.
