Statutory guidance for Scotland's Redress Scheme. This guidance provides further information on the payment of legal fees.
Review of the assessment of a fee payment request
41. Where Redress Scotland has assessed a fee payment request, a solicitor may, within 8 weeks of receiving notification of Redress Scotland’s assessment, request a review of it. Requests made outwith that 8 week period may also be considered if Redress Scotland is satisfied that the solicitor had good reason for not making the request sooner. An example of a circumstance which may amount to good reason may be where there has been a demonstrable difficulty in the solicitor obtaining instructions or information needed from the applicant in time.
42. The review is to be considered by a review panel consisting of at least 2 members of Redress Scotland. Further information on the reviews process can be found in the reviews guidance.
43. A request for a review can be withdrawn at any time prior to the outcome of the review assessment by the solicitor asking to withdraw in writing to the Scottish Ministers.
