Routes to redress and justice which cannot be pursued after accepting an offer of redress
Raising civil proceedings against an organisation which has contributed to the scheme
37. If the applicant has received an offer of a redress payment (whether or not after a review), the applicant may choose not to accept the offer. In that case, the waiver would not be signed and the applicant will continue to have the right to raise or continue civil proceedings against any organisation on the scheme contributor list. But once a waiver has been signed, it will no longer be possible to raise or continue civil proceedings against such an organisation.
38. As before, raising civil proceedings is not an option available to pre-1964 survivors.
