Form which must be used by the Part 5 Community Body to apply for the Right to Buy Land to Further Sustainable Development.
A community body wishing to apply for a Right to Buy Land to Further Sustainable Development is required to complete the attached application form.
Please note that the application form must be downloaded and then completed using the version stored on your personal device and using Adobe Acrobat Reader. If you attempt to complete the form online (and then download and save) or if you attempt to complete the form using software other than Adobe Acrobat Reader then you may encounter issues with this form.
You can download the Adobe Acrobat Reader software for free from the Adobe website: https://www.adobe.com/uk/acrobat/pdf-reader.html.
If you have access to Adobe Acrobat Pro then this software can also be used. Alternatively, the form can be printed, completed manually and then scanned and saved as a PDF.
If you require more space within the text boxes provided, additional annexes can be submitted with your application form. Any annexes should be clearly marked to indicate the question to which your answer relates, and a note of the Annex reference should be noted within the relevant section of the application form. If your answer exceeds the text box (an error which may present when completing the form online) we will have no option but to decline to consider your application.
Section 5 of the application form requires a community body to demonstrate community support for its proposal to exercise the right to buy. This must be demonstrated by undertaking a ballot of the defined community and then publishing the ballot result in the prescribed format. The ballot must be undertaken during the six month period immediately preceding the submission of an application form. An online ballot will not be accepted. These requirements are outlined under Part 5 of the Land Reform (Scotland) Act 2016.
The ballot of the community and the publication of the ballot result must be carried out in accordance with the provisions of the Right to Buy Land to Further Sustainable Development (Applications, Written Requests, Ballots and Compensation) (Scotland) Regulations 2020. The Part 5 Right to Buy guidance must be referred to for details of this process.
It is strongly recommended that all compliant community bodies submit a draft application form prior to the final version of the application form. The Community Land Team will then assess the application form for any compliance issues, i.e. mandatory criteria which must be met before we can accept your application form. Draft application forms should be emailed to the crtb@gov.scot mailbox.
The completed application form, including maps, publication of the ballot result (if not already submitted) and supporting documentation, should be emailed to the crtb@gov.scot mailbox.
