The Scottish Water (Security) (Scotland) Directions 2017
Made: 4 April 2017
Coming into force: 5 April 2017
The Scottish Ministers give the following Directions to Scottish Water in exercise of the powers conferred by sections 56 and 56A of the Water Industry (Scotland) Act 2002 and all other powers enabling them to do so.
In accordance with section 56(4) of that Act, the Scottish Ministers have consulted Scottish Water.
In accordance with section 56A(4) of that Act, the Scottish Ministers have consulted every water services provider and sewerage services provider and Citizens Advice Scotland.
Citation, commencement and interpretation
(1) These Directions may be cited as the Scottish Water (Security) (Scotland) Directions 2017 and come into force on 5 April 2017.
(2) In these Directions, "the security objectives" means the requirements of paragraph 12 (security of supply) of the schedule to the Scottish Water (Objectives: 2015 to 2021) Directions 2014.
Modified security objectives
Scottish Water is directed to exercise its functions so as to comply with its obligations in respect of the security objectives but with the modification that paragraph 12(1) of the security objectives is substituted with—
- 12(1) Scottish Water must provide an appropriate level of physical, personnel and cyber security to meet the standards agreed with the Scottish Ministers and their advisers.

Explanatory note
(This note is not part of the Directions)
The Scottish Water (Security) (Scotland) Directions 2017 direct Scottish Water to exercise its functions so as to comply with its obligations in respect of the requirements of paragraph 12 (security of supply) of the schedule to the Scottish Water (Objectives: 2015 to 2021) Directions 2014, but with a modification. In formulating the modification, the Scottish Ministers had regard to Scottish Water's duty under section 51(1) of the Water Industry (Scotland) Act 2002.
In accordance with section 56(5) of that Act, Scottish Water must comply with these Directions.
