List of Strategic Environmental Assessment (SEA) screening determinations.

Deposit return scheme: screening determination

Letter confirming that The Deposit and Return Scheme for Scotland Amendment Regulations 2025, and The Deposit and Return Scheme for Scotland (Designation of Scheme Administrator) Order 2025 are unlikely to have significant environmental effects, not already considered in previous assessments, therefore a further Strategic Environmental Assessment is not required.

Environmental Assessment (Scotland) Act 2005: Section 8(1) Screening - The Deposit and Return Scheme for Scotland Amendment Regulations 2025, and The Deposit and Return Scheme for Scotland (Designation of Scheme Administrator) Order 2025

Statement – screening determination

I refer to the screening report prepared for the above noted regulations and order, which was submitted to the SEA Gateway on 17/12/2024. Responses from the Consultation Authorities were received on 14/01/2025. The Consulting Authorities have agreed that the above regulations and order are unlikely to have significant environmental effects as previous assessments have assessed all likely significant effects resulting from the proposed scheme.

I am writing on behalf of the Directorate for Environment and Forestry to confirm that the Scottish Government has determined, using the criteria set out in Schedule 2 of the Environmental Assessment (Scotland) Act 2005, that The Deposit and Return Scheme for Scotland Amendment Regulations 2025 and The Deposit and Return Scheme for Scotland (Designation of Scheme Administrator) Order 2025 are unlikely to have significant environmental effects, not already considered in previous assessments. A further Strategic Environmental Assessment is therefore not required.

I enclose a copy of the determination advert which will be placed in The Herald. I would be grateful if you could forward this to the SEA Consultation Authorities.

Please do not hesitate to contact me should you require any further information.

Yours sincerely,

David McPhee
Deputy Director
Circular Economy Division
