Letter confirming that the ban on the sale and supply of single-use vapes will have a significant environmental impact, and a Strategic Environmental Assessment is therefore required.
A strategic environmental assessment (SEA) screening report was prepared for the proposed prohibition of the sale and supply of single-use vapes and was issued to the SEA Consultation Authorities on 23 February 2023. Responses from the Consultation Authorities were received on 7 February 2024, whose overall opinion was that there is a likelihood of significant environmental effects.
On this page is:
- a letter from the Scottish Government to the SEA consultation authorities confirming that we have determined that the prohibition of the sale and supply of single-use vapes is likely to have significant environmental effects and a Strategic Environmental Assessment is therefore required
- an advert that will be placed in the Edinburgh Gazette and The Herald notifying the same
Environmental Assessment (Scotland) Act 2005: Section 8(1) Screening - prohibition of the sale and supply of single-use vapes
I refer to the screening report prepared for the Prohibition of the sale and supply of single-use vapes, which was submitted to the SEA Gateway on 23/02/2024. Responses from the Consultation Authorities were received on 07/03/2024, whose overall opinion was that there is a likelihood of significant environmental effects.
I am writing on behalf of the Directorate for Environment and Forestry to confirm that the Scottish Government has determined under section 8(1), using the criteria set out in Schedule 2, of the Environmental Assessment (Scotland) Act 2005, that the Prohibition of the sale and supply of single-use vapes is likely to have significant environmental effects. A Strategic Environmental Assessment is therefore required.
I enclose a copy of the determination advert which will be placed in the Edinburgh Gazette and The Herald. I would be grateful if you could forward this to the SEA Consultation Authorities.
Please do not hesitate to contact me should you require any further information.
Yours sincerely,
Product Stewardship Team
