Statistical information on offences and convictions: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.


Information requested

Information regarding crimes of dishonesty:

  1. How many convictions are there per year of offences involving dishonesty?
  2. Is any data available on the current number of unspent convictions for such offences?

You also asked for information regarding the following crimes and offences: perjury, perverting the course of justice, misconduct in public office, contempt of court and specified bribery, terrorism and money laundering offences. Individuals subject to terrorist asset freezing orders. Individuals subject to notification requirements of Part 2 Sexual Offences Act 2003 (on the Sex Offenders register)

  1. How many convictions are there per year for the offences listed above?
  2. Is any data available on the current number of unspent convictions for such offences?
  3. Is any data available on the number of individuals who are subject to terrorist asset freezing orders?
  4. Is any data available on the number of individuals subject to notification requirements of Part 2 of the Sexual Offences Act 2003?

Response

The answer to questions 1 and 3 is provided in the attached excel workbook. I have provided total prosecutions and convictions of the crime groups in question and also included further breakdowns by crime type for clarity.

The Scottish Government does not have the information you requested in questions 2 and 4 regarding unspent convictions because it is not responsible for this information. This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.

Question 5 - terrorist asset freezing orders:

This is a reserved function and information on UK legislation and the relevant guidance can be obtained from the Counter-Terrorism (Domestic) financial sanctions page on the Gov.UK website https://www.gov.uk/government/collections/uk-counter-terrorism-sanctions. Those persons who are designated under this regime are included on the UK sanctions list. There are two other counterterrorism sanctions regimes: the ISIL (Da’esh) and Al-Qaida sanctions regime and the Counter-Terrorism (International) sanctions regime.

Some of the information you have requested regarding question 6 is available from Police Scotland at Registered Sex Offender (RSO) Numbers - Police Scotland. Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you.
