Staying together and connected: getting it right for sisters and brothers: national practice guidance

Guidance supporting implementation of the new duties for Scottish local authorities: that every looked after child will live with their brothers and sisters, where appropriate to do so. Siblings should be supported to sustain lifelong relationships, if appropriate, even if they cannot live together.


17. Transitional arrangements

Some children were placed with foster carers (where this resulted in more than three unrelated children residing in the household) during the period in which paragraph 10(5) of Schedule 3 of the Coronavirus Scotland Act 2020 was in force (4th April 2020 to 30th September 2021), i.e. whilst the three-child placement limit had been temporarily removed.

Local authorities will be aware that on 30th September 2021, this provision expires. For children placed under this emergency legislation, 30th September 2021 is considered to be the beginning of the four week period in which the local authority must make a referral to the fostering panel if exceptional circumstances exist and the placement is sought to continue.[140] If the placement should not continue in the longer term, the child can remain there for up to four weeks from 30th September 2021 (under Regulation 27A(2)(b) of the 2009 Regulations) to ensure planned transitions are facilitated.
