Information request and response under the Freedom of Information (Scotland) Act 2002.

Information requested

  1. All details and sums of fines imposed on CalMac by Transport Scotland due to service delays and cancellations from 01/01/2018 to 01/01/2023 broken down by year
  2. Where the fines and resultant monies have subsequently been allocated and/or used
  3. Whether the Scottish Government has allocated the resultant fines and monies for business support schemes similar to the Edinburgh tram network system

Response

Most of the information you have requested is available from published FOISA requests at Publications - gov.scot (www.gov.scot) Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you. If, however, you do not have internet access to obtain this information from the website(s) listed, then please contact me again and I will send you a paper copy.

With regards to your first point -

All details and sums of fines imposed on CalMac by Transport Scotland due to service delays and cancellations from 01/01/2018 to 01/01/2023 broken down by year

The majority of the information requested can be found within the following links:

  CHFS2
CY06 Oct 2021 - Sept 2022 £3,088,064
CY07 (to date) Oct 2022 - Mar 2023 £1,454,997

Regarding your second and third points -

  • Where the fines and resultant monies have subsequently been allocated and/or used
  • Whether the Scottish Government has allocated the resultant fines and monies for business support schemes similar to the Edinburgh tram network system

These were not fines; under the Clyde and Hebrides Ferry Services (CHFS) contract, performance deductions can be applied by Transport Scotland in certain circumstances when sailings are late or cancelled. These performance deductions are then offset against the grant subsidy paid for operating the ferry services. They are not used for business support schemes.
