As the majority of the type of education the Bill supports delivery of is currently provided on a non-statutory basis, creating this new statutory framework provides greater certainty of the range of education and training available to children and young people in Scotland.

8. If you have identified a positive impact on children’s rights, please describe below how the proposal will protect, respect, and fulfil children’s rights in Scotland.

The provisions in the Bill are not specifically for children and young people. Only through the implementation of future policies facilitated by this Bill, will the impact on children and young people potentially be realised. Therefore, only indirect impact is assessed in relation to the right to education (Article 28) and protection from child labour (Article 32). Otherwise, the Bill is considered to have no impact.
